"you" and "your" mean any Eligible Clients(s)

"we", "our" and "us" mean Canadian Western Bank; and

1. Offer

   The New CWB Kitchener Personal Banking Offer (the "Offer") begins on March 3, 2025 at 12:01 a.m. (ET) and ends on May 31, 2025 at 11:59 p.m. (ET) (“Offer Period”). This Offer consists of a $250 gift card from Vincenzo’s (“Gift Card”) and a contest entry to win one of five 1-year $1000 Canadian Dollar GICs for (i) opening a Chequing Account with NBC (the “Account”), and (ii) purchasing one or more guaranteed investment certificates (“GIC(s)”), the sum of which equal $2,500 Canadian Dollars or greater. Please contact the Kitchener branch to determine which products are eligible for this offer.

2. Eligibility

   This Offer is open to (i) residents of Canada (excluding residents of Quebec) (ii) who have reached the age of majority (iii) during the Offer Period (iv) who at the time of opening the Account, were not a holder (or joint holder) of a NBC chequing account in the twelve months prior to the Offer Period, as determined by NBCon the basis of its official records, and (v) are not active or retired employees, directors or officers of NBC or any of its affiliates. Unless otherwise indicated, this Offer cannot be combined with any other chequing account offer, rebate or reward. Individuals who meet the foregoing eligibility requirements and comply with these terms may be referred to as "Eligible Client(s)". For joint Accounts, all joint account holders must be Eligible Clients at the time of opening the Account.

3. Offer Requirements

   To qualify for the Offer, you must:

   1. Open your Account in person at the Kitchener branch located at 50 Sportsworld Crossing, Suite E1-01A, Kitchener, ON, N2P 0A4; and
   2. Purchase one or more non-redeemable Canadian dollar GICs at the Kitchener branch located at 50 Sportsworld Crossing, Suite E1-01A, Kitchener, ON, N2P 0A4 during the Offer Period, the aggregate of which are equal to the sum of $2,500 Canadian Dollars.
4. Prizes 
   1. $250 Gift Card from Vincenzo’s. The prize is not transferable and cannot be substituted by the winner for cash or otherwise and must be accepted as awarded. We reserve the right, in our absolute discretion, to make substitutions of equivalent kind or value in the event of unavailability of all or part of the prize for any reason whatsoever. 
   2. One (1) entry to win one of five 1-year $1000 Canadian Dollar GICs. Draw to take place June 13, 2025. Additional terms apply. See contest rules below for details.
5. Offer limits

   Limit of one (1) Gift Card per Eligible Client. For joint accounts, only one (1) Gift Card is available per Account.

6. Offer fulfillment and conditions

If you do not receive the Gift Card, you have until nine (9) months after the month that the Account was opened to tell us that the Gift Card was not received. If you do not tell us by this time, you will be deemed to have forfeited your right to the Gift Card and to have not qualified for the Offer.

If you downgrade, convert or close your Account, or cancel any recurring Qualifying Actions at any time before one (1) year after the month that the Account was opened, we reserve the right to disqualify you from receiving the Gift Card or if the Gift Card has been paid, we reserve the right to withdraw from your Account, or any of your accounts with NBC, the value of the Gift Card even if this places you into overdraft. If you do not have a NBC bank account with us at that time, we may send you an invoice for the value of the Gift Card, which you agree to pay within 30 days of its postmark date.

 General terms and conditions

This Offer is subject to all applicable federal, provincial and municipal laws. The decisions we make with respect to all aspects of this Offer are final and binding on all clients without right of appeal, including, without limitation, any decisions regarding the eligibility of any person. By participating in this Offer, you are agreeing to be bound by these terms.

We reserve the right, in our sole and absolute discretion, to end, cancel, change or suspend this Offer, or to change these terms, at any time, for any reason without notice. We reserve the right, in our sole and absolute discretion, to disqualify any person we find or believe (using any evidence or other information made available to or otherwise discovered by us) to be manipulating or otherwise abusing the process, fairness, integrity or operation of the Offer. Except as modified, the terms and conditions relating to existing products/services will remain in full force and effect.

By participating in this Offer you agree to NBC collecting, using, disclosing and sharing your personal information to administer this Offer. CWB may share this information with third parties who may be outside of your province or Canada.

Participants, including eligible clients, who do not wish to provide their email address will not be eligible for the Offer, but will still be able to open an Account.

In the event of any discrepancy or inconsistency between these terms and conditions and disclosures or other statements contained in any Offer-related materials, including, but not limited to point of sale, television, print or online advertising, these terms and conditions shall prevail, govern and control to the fullest extent permitted by law.

Each Essay must:

1. be an original composition of the author, and be written about the identified Essay topic;
2. not have been previously published or submitted for this or any other Contest sponsored by Sponsor;
3. not infringe on the privacy or intellectual property rights of any third party;
4. be in good taste and in keeping with the Sponsor’s corporate image;
5. be a minimum of 250 words; and
6. be handwritten or handprinted.
   

Essays must be:

1. Submitted in a hand-addressed outer envelope and mailed to CWB Kitchener Personal Promotion11th flr, 10303 - Jasper Avenue,  Edmonton, Alberta T5J 3N6

All Essays must be received by Sponsor by 5:00 pm ET on May 31, 2025. For each qualifying Essay, the Entrant will receive one (1) Entries.

ENTRY LIMIT: Limit of one (1) Contest entry during the Contest Period, per individual. You may only be awarded one prize during the Contest Period. NOTE: Fraudulent methods of entry or circumvention of the rules may result in the Sponsor invalidating your entries and removing them from the giveaway at the Sponsor's sole discretion.

6. Selection and Notification of Winner: The Winner (as defined below) will be selected by random draw from all eligible entries received, and such Entrant will be eligible to win the prize. Before being declared a Winner, you must correctly answer a skill-testing mathematical question. The Sponsor will notify the Winner(s) by within 30 days of selection. The Sponsor is not responsible for nor shall have no liability for Winner's failure to receive notices due to privacy or security settings that may cause notifications to be marked as spam or junk. Nor shall be Sponsor be liable for the Winner's provision of incorrect or otherwise non-functioning contact information. If the Winner 1) fails to claim the prize within 14 days from the time the award notification was sent, 2) is found ineligible, the prize may be forfeited and an alternate Winner may be selected. Receipt of the prize by the Winner is upon the condition of compliance with all federal, provincial, and local laws and regulations. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR'S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

7. Prizes: The winner(s) of $1000 GIC Contest (the “Winner”) will receive 1 of 5 available 1-year $1000 Canadian Dollar GICs. The actual/appraised prize value may differ at the time the prize is awarded. The prize(s) shall be determined solely by the Sponsor. There shall be no cash or other prize substitution permitted except at the Sponsor's discretion. The prize is non-transferable. The Winner, upon acceptance of the prize, is solely responsible for all expenses related to the prize, including without limitation any and all local, provincial, and federal taxes. The Winner shall not transfer assignment of the prize to others nor shall the Winner request the cash equivalent or prize substitution. By accepting the prize, the selected Winner grants permission for the Sponsor to use the Winner's likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.

8. Odds: The total number of eligible entries received determines the odds of selection.

9. Rights Granted by You: By submitting an entry into this giveaway, you understand and agree that the Sponsor, any individual acting on the Sponsor's behalf, and the licensees successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, likeness, image, statements about $1000 GIC Contest giveaway, and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.

10. Terms & Conditions: In its sole discretion, the Sponsor reserves the right to modify, suspend, cancel, or terminate the $1000 GIC Contest giveaway should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Sponsor's control, impact or corrupt the security, fairness, proper conduct, or administration of the $1000 GIC Contest giveaway. The Sponsor, in the event of any of the above issues, may determine the Winner based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the giveaway or website or violates these Official Rules will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the $1000 GIC Contest giveaway, to void votes for any reason, including, but not limited to: multiple entries from the same user; multiple entries from the same computer beyond the number allowed by the giveaway rules; or the use of bots, macros, scripts, or other technical means for entering. Attempts by any entrant to deliberately damage any website or undermine the legitimate operation of the $1000 GIC Contest giveaway may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.

11. Limitation of Liability: Your entry into this giveaway constitutes your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the giveaway and/or the 1) Winner accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Promotion; 5) electronic error or human error in the Promotion administration or the processing of entries.

12. Disputes: This giveaway is governed by the laws of Canada and Alberta without respect to conflict of law doctrines. You agree, as a condition of participating in this promotion, that if any disputes cannot be resolved between you and the Sponsor, and if causes of action arise out of or are connected with this giveaway, they shall be individually resolved exclusively before a court located in Alberta having jurisdiction, without resorting to any form of class action. Under no circumstances in any such dispute shall the participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this giveaway). The participant waives all rights to have damages multiplied or increased.

14. Winners List: You may obtain a copy of the Winner’s name(s) or a copy of these Official Rules, by sending your request via mail with a stamped, self-addressed envelope to: 3000-10303 Jasper Avenue NW, Edmonton AB T5J 3X6. Requests must be postmarked no later than December 31, 2025.
